General Terms and Conditions (Master) - Flex & Connect Study

1. Subject matter of the contract
The subject matter of this contract is the completion of a distance learning programme at SRH Fernhochschule Riedlingen, a state-recognised university located at Kirchstr. 26, 88499 Riedlingen (hereinafter referred to as SRH Fernhochschule). The aim of the distance learning programme is, depending on the course selected, to obtain a Master of Business Administration (MBA), Master of Arts (M.A.), Master of Science (M.Sc.) or Master of Laws (LL.M.) degree

2. Contracting parties
The contract is concluded between the student and SRH Fernhochschule GmbH, Kirchstr. 26, 88499 Riedlingen, which is the operating company of SRH Fernhochschule.

3. Conclusion of the contract
Offers, enquiries or other requests from students do not constitute a binding contractual offer, but merely a request to the distance learning university to submit an offer or declare acceptance. The study contract is only concluded upon express acceptance by SRH Fernhochschule GmbH, usually in the form of a written order confirmation.

4. Tuition fees:

4.1 The student is obliged to pay the tuition fees. If a third party pays the fees, the parties are jointly and severally liable. Fees are payable in euros. Any fees incurred for payments/ transfers are not covered by SRH Fernhochschule, but are to be borne by the party responsible for payment.
4.2 The fees applicable to the chosen degree programme or financing model are specified in this distance learning contract. The fees incurred during the standard period of study are due for payment at the end of the respective month.
4.3. The tuition fees include:
— Personal contact person in student services
— Support from a personal mentor from the academic teaching staff at SRH Fernhochschule, e.g. professors (mentor programme)
— All study materials for the respective degree programme in digital form (with the exception of legal texts for law exams and modules in which printed textbooks are used)
— E-Campus with all information about the degree programme, discussion forums, access to study materials, audiovisual media, interactive exercises, online events and study groups, etc.; also available as an app
— Digital tools such as Office 365, Citavi, software for academic work and various online libraries
— All examinations and the assessment of the Master’s thesis, repeat examinations in the event of failed examinations in accordance with the provisions of the valid study and examination regulations
— Issuing of performance certificates, certificates and transcripts
— SRH social guarantee (see B.9. ‘Social guarantee’)
The tuition fees do not include, in particular:
— The costs of telephone, internet, postage and data transmission, and additional work materials such as legal texts
— The costs of travel, accommodation and meals when participating in accompanying events/examinations
4.4. Students choose the payment period and thus the amount of the monthly tuition fees individually (Flex 1 or 2). If Flex 2 is chosen (only available to residents of the EU or Switzerland, Norway, Liechtenstein and the United Kingdom), the monthly tuition fees are reduced for longer payment periods and higher total fees. Regardless of the model chosen, SRH Fernhochschule provides all services in full; these services correspond to the equivalent value of the monthly tuition fees for Flex 1. After the start of the programme, only one change (only applies to students in the EU or Switzerland, Norway, Liechtenstein and the United Kingdom) to another Flex model is possible. The change from Flex 2 to Flex 1 is subject to a change fee of €650 and is only possible within the first 12 months after the start of studies. The fee is due within 30 days of the model change. The difference between the previous payment model and the new payment model that has arisen since the start of studies must be settled by a one-time payment within 30 days. The change from Flex 1 to Flex 2 is possible without a change fee; in this case, the total fee specified in the contract for the Flex model selected after the change is due.

1. Structure
A course comprising 60 credit points (ECTS) has a standard duration of 2 academic semesters, a course comprising 90 credit points (ECTS) has a standard duration of 3 academic semesters, and a course comprising 120 credit points (ECTS) has a standard duration of 4 academic semesters. The number of credit points (ECTS) depends on your choice of degree programme. Study progress is monitored online via the SRH Fernhochschule E-Campus. Students are responsible for ensuring that they have the necessary technical equipment (hardware and software) to participate in the SRH Fernhochschule E-Campus.

2. Completion of the programme
The completion of the programme is governed by the applicable study and examination regulations and the associated currently valid implementation regulations, which form an integral part of the study contract.

3. Semester of leave
In cases of impediment, a leave of absence for a period of six calendar months may be requested. The leave of absence begins on the first day of the calendar month following the submission of the request. Up to two leaves of absence are possible without giving reasons. Further semesters of leave may be granted if proof of protected periods (e.g. maternity leave, parental leave, care leave) is provided. During a semester of leave, the rights and obligations under this contract are suspended for both the student and SRH Fernhochschule. No tuition fees are payable during the semester of leave. The distance learning contract cannot be terminated during a semester of leave; the right to extraordinary termination for good cause remains unaffected. Once the distance learning contract has been terminated, it is no longer possible to apply for a semester of leave. No initial examinations may be taken during a semester of leave. Examination repeats (second and third attempts) may be taken during a semester of leave. Separate regulations apply to Connect Study (online evening study) (see B. 12. ‘Separate conditions for Connect Study courses’).

4. Extension or reduction of the duration of study
The tuition fees include supervision for twice the standard period of study (see the respective degree programme for the standard period of study). If the degree programme is continued beyond twice the standard period of study, monthly tuition fees amounting to 50% of the regular tuition fees for Flex 1 of the chosen degree programme will be charged; discounts and reductions cannot be applied. If the programme is successfully completed before the end of the standard period of study, the total tuition fees selected remain unaffected. All fees must be paid in full before the final certificate can be issued.

5. Assessments and final thesis
Assessments are carried out by module. Some of these require personal attendance at a study/examination centre of the SRH Fernhochschule. The student grants the SRH Fernhochschule the right to have submitted examination papers checked for plagiarism using plagiarism detection software. The programme concludes with a final thesis (Master’s thesis).

6. Recognition or crediting of prior academic achievements and examination results
Academic achievements and examination results obtained in another qualified educational programme may be recognised upon application in accordance with the applicable study and examination regulations. Recognition is granted after individual review by SRH Fernhochschule. For each credit point (ECTS) credited, the tuition fee is reduced at the end of the programme. After the standard period of study has expired, recognition of examination achievements no longer leads to a reduction in tuition fees. When resuming an interrupted course of study at SRH Fernhochschule, the amount of the reduction in the total costs cannot exceed the amount of payments made to date.

7. Minimum number of students
If the minimum number of five students for a degree programme is not reached, the university reserves the right to cancel or postpone the start of the respective degree programme. Separate regulations apply to online evening courses (see B. 12. “Special conditions for Connect Study programmes”). If the minimum number of five students is not reached for face-to-face courses, the university reserves the right to cancel the course or to hold it as an online course. Any travel or accommodation costs incurred will only be reimbursed if the cancellation is made less than 14 days before the start of the course and the university is responsible for the short-term cancellation. There is no entitlement to the holding of a face-to-face course.

8. Change of premises
SRH Fernhochschule operates study centres in Germany, Austria, Italy, the Netherlands and Switzerland. SRH Fernhochschule is entitled to change locations or reduce the number of centres after giving reasonable notice.

9. Social guarantee of SRH Fernhochschule
If unforeseeable, important reasons arise after commencing your studies (e.g. long-term illness, unemployment), you can apply to SRH Fernhochschule for a temporary deferral of monthly fees for a maximum of 6 months upon presentation of evidence. After an internal review of the application, it may be approved. You can continue your studies in full.

10. Additional services
Any additional services are not part of this contract. Students at SRH Fernhochschule can take additional modules and participate in study days and study trips, during which they can take examinations. These additional courses may be subject to a fee.

11. Change of study model
If, for reasons that are unforeseeable and beyond the control of SRH Fernhochschule, it becomes impossible or unreasonable for the university to conduct the programme, in particular the courses, in accordance with the study regulations, it shall be entitled to conduct the programme, and in particular the courses, in an appropriate alternative manner, provided that this is reasonable for the student and, in particular, does not lead to an extension of the duration of study or an adverse change in the intended degree. The right to extraordinary termination for good cause remains unaffected. If the change in the study model is unreasonable for the student, there is the option of extraordinary termination or a reduction in tuition fees in accordance with the statutory provisions.

12. Special conditions for Connect Study programmes
The Connect Study programme (also referred to as ‘online evening study’) is a digitally organised programme that, in addition to regular distance learning, includes regular live online courses in a fixed study group as well as extended individual support services.
12.1. The Connect Study programme begins on April 1st and October 1st of each calendar year. Participation costs €33 per month for a period of 12 months for 60 credit points (ECTS), totalling €396; 18 months for 90 credit points (ECTS), totalling €594; and 24 months for 120 credit points (ECTS), totalling €792, in addition to the regular tuition fees (A.4. Tuition fees). If you switch from Flex Study to Connect Study, the respective fee for the selected number of credit points is payable in full as a one-off payment upon invoicing, with a payment deadline of 30 days.
12.2. The Connect Study programme can be taken within the standard period of study in accordance with the semester and module sequences specified in the curriculum for the respective cohort. Courses that are not attended do not entitle students to compensation; corresponding modules can be completed through self-study.
12.3. A semester of leave can be requested on 1 April or 1 October of each calendar year.
12.4. It is possible to switch between Connect Study and Flex Study programmes for a fee. There is no entitlement to switch; the decision is at the discretion of SRH Fernhochschule
12.5. If fewer than 20 registrations are received for the Connect Study programme by April 1st or October 1st of a calendar year, SRH Fernhochschule reserves the right to cancel or postpone the start of the respective programme in Connect Study format. In this case, no fees will be charged for the Connect Study programme.

1. Internet access
Access to an internet-enabled device with a current operating system is essential. Devices include desktop PCs, laptops, tablet computers and smartphones, provided they meet the technical requirements for using the E-Campus and digital study materials. A telephone number is also required to use the E-Campus.

2. Student ID card
The student ID card is provided digitally via an app. This is available in the respective app store. The card can be printed and sent for a processing fee of €50 (only for residents of the EU or Switzerland, Norway, Liechtenstein and the United Kingdom). If the card is lost, a processing fee of €50 will also be charged for reissuing it.

3. E-Campus and communication
The E-Campus, an internet-based communication and learning platform, is an integral part of the SRH Fernhochschule‘s study concept. Information from the SRH Fernhochschule is made available to students via this platform and via the university‘s internal email address. Therefore, active participation in the ECampus and checking the email inbox, which is part of the ECampus, is essential for studying at SRH Fernhochschule. For some modules in the design courses, access to Adobe Collection, Adobe XD or comparable editing software is required. This is not provided by the university.
3.1. Terms of use
Students may only use the E-Campus for study and teaching purposes. The transfer of usage rights and any content of the E-Campus and the associated subsystems (online libraries, etc.) to third parties is not permitted. When using the E-Campus, students may not violate German laws and regulations, public decency or the rights of third parties (copyright, data protection, etc.).
3.2. Data protection notice
Personal data is processed exclusively in accordance with the applicable data protection laws, in particular the GDPR. The university informs students in a separate data protection notice, available at https://www.srh-distance-learning-univer¬sity.com/data-processing, about the type, scope and purpose of data processing and about their rights (information, correction, deletion, objection). Data will only be passed on to third parties if this is required by law or necessary for the fulfilment of a contract. The use of the E-Campus is logged exclusively for the purpose of ensuring system security, error analysis and proper use. Only authorised administrators have access to log data. SRH Fernhochschule, together with Microsoft as the provider of Microsoft 365, takes the necessary technical and organisational measures to ensure the security and availability of the data and tools provided free of charge with Microsoft 365 as a supplement to the E-Campus. SRH Fernhochschule does not create any additional backup copies of the data stored in Microsoft 365. Microsoft Ireland Operations Limited is used as a processor for the use of Microsoft 365. Data may be transferred to the USA within the framework of the EU-US Data Privacy Framework or on the basis of standard contractual clauses.
3.3. Placement agency
The student agrees that SRH Fernhochschule may inform any placement agencies that have arranged this study contract about the conclusion of this study contract and may also inform them whether the payments for the first 6 months have been received.
3.4. Data processing
Upon signing the contract, the terms of use set out in section 3.1 shall apply. SRH Fernhochschule processes personal data for the purpose of fulfilling the contract. Revocation of consent to data processing during the statutory contract revocation period and the additional trial period in accordance with D.1. will result in the immediate and irrevocable deletion of all personal data, provided that this does not conflict with any statutory retention obligations (e.g. for examination results or accounting documents). In such cases, the relevant data will be stored until the expiry of the statutory periods and then deleted. Revocation of consent to data processing after expiry of the statutory contract cancellation period and the additional trial period in accordance with D.1. automatically results in termination of the study contract in compliance with the contractually stipulated periods. The data will be deleted immediately and irretrievably at the time the termination takes effect, taking into account statutory retention obligations.
3.5. E-Campus
The E-Campus is available to students for the duration of their studies. Regular security and functional updates may lead to system downtime. Where possible, this will be announced in advance.

4. Study material
Students are obliged to observe the copyrights existing on the materials, content and media – including those in digital form – and not to reproduce them or make them available to third parties free of charge or sell them.

1. Right of withdrawal and additional trial period:
Students have a statutory right of withdrawal of 14 days from the day on which services are first made available to them as part of their studies (start of studies). Details can be found in the following withdrawal policy. Beyond the statutory withdrawal period, SRH Fernhochschule voluntarily grants an additional trial period of a further 14 days. This results in a total 4-week trial period (28 days from the start of the study programme; days 1–14 are the statutory withdrawal period, days 15–28 are the voluntary trial period), during which students can use all of the university‘s services without obligation.
— Withdrawal: Within the first 14 days of the start of the study programme, the contract can be withdrawn without giving reasons (e.g. by email to info@srh-dlu.com).
— Cancellation: From the 15th to the 28th day after the start of the study programme, the contract can be terminated in writing without notice. No costs will be incurred during this period either.
If the contract is withdrawn or cancelled during the entire 4-week trial period, no tuition fees will be charged. If the distance learning programme is continued after the trial period has expired, this time counts towards the regular duration of study and will be charged accordingly.

2. Contract term/Notice period:
2.1. The contract ends upon successful completion of the course of study. The minimum contract term is 6 months. The student may cancell this contract in writing for the first time at the end of the first six months after conclusion of the contract, subject to a notice period of 6 weeks, and thereafter at any time with a notice period of 3 months to the end of the month. The right to extraordinary termination for good cause remains unaffected.
2.2. SRH Fernhochschule is entitled to cancell the contract for good cause, in particular if the student
— fails to meet his/her payment obligations on time despite repeated reminders,
— repeatedly violates the terms of use of the E-Campus,
— revokes his/her consent to the necessary data processing in accordance with C.3.4.,
— fails to provide the required proof of health insurance.
2.3. Notice of termination must be given in writing. There is no entitlement to a refund in the event of termination. Services will continue to be provided in full until the end of the notice period.
2.4. Under the Flex 2 financing model, the payments made by the student do not correspond to the value of the services provided. The services provided correspond to the equivalent value of the Flex 1 tuition fees. The difference between the payments made by the student and the services provided by SRH Fernhochschule must be settled with a final payment in the event of ordinary or extraordinary termination. Payment is due within 30 days of the termination taking effect.

3. Change of personal details
Changes to your address, name, account details or private email address must be notified to SRH Fernhochschule in writing without delay.

4. Contract amendments
Amendments and additions to this contract must be made in writing and require the consent of both contracting parties; unilateral contract amendments are not permitted. There are no subsidiary agreements. Individual agreements must be made in writing to be valid.

5. Warranty provisions
SRH Fernhochschule GmbH guarantees that, in the event of the SRH Fernhochschule ceasing to operate in Germany and Austria, all students of the SRH Fernhochschule will be able to complete their studies.

6. Place of jurisdiction
German law applies to any disputes arising from this contract. The place of jurisdiction is generally the court responsible for the student‘s place of residence. In the event that the student moves his/her place of residence or habitual abode outside the Federal Republic of Germany after conclusion of the contract or is unknown at the time the action is brought, the place of jurisdiction shall be the court responsible for the registered office of SRH Fernhochschule GmbH.

Payment method

SRH Fernhochschule collects the fees via the selected payment model. Payment is made in monthly instalments at the end of the month, but at the earliest after the 4-week trial period has expired. In the event of late payment, the University reserves the right to charge the fees for returned direct debits and/or to charge a reminder fee of €5 from the first reminder
